DMCA & Copyright Policy

1. Overview

FoundFrame respects the intellectual property rights of others and expects its users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid takedown notices.

FoundFrame is a search and analysis tool. We do not host videos on our servers. Our AI agent searches publicly available video content, identifies timestamps, and may extract clips at the user's request using standard tools. The original content remains on the source platform, hosted by the content creator.

2. DMCA Takedown Notice

If you believe that content accessible through FoundFrame infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to be infringed.
  3. Identification of the material that is claimed to be infringing, including sufficient information for us to locate it (e.g., URLs, search queries, clip details).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

We aim to respond to valid DMCA notices within 5 business days.

4. Counter-Notification

If you believe your content was removed or disabled in error, you may submit a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or Delaware, if outside the US) and will accept service of process from the person who submitted the original notice.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore access to the removed material.

5. Repeat Infringer Policy

FoundFrame maintains a policy for terminating accounts of repeat infringers in appropriate circumstances. If a user receives multiple valid DMCA takedown notices, we may:

  • Issue a warning to the user.
  • Temporarily suspend the user's account.
  • Permanently terminate the user's account.

We assess each case individually and consider the nature and severity of the alleged infringement.

6. How FoundFrame Handles Content

To be clear about our role in the content ecosystem:

  • We do not host, upload, or store videos on our servers.
  • We provide links to publicly available video content with timestamp references.
  • Clip extraction is performed at the user's request for their personal or licensed use. Users are responsible for ensuring their use complies with copyright law.
  • Saved clips in user libraries reference video metadata and timestamps; the underlying video content is not hosted by us.

7. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. Please ensure your claims are made in good faith before submitting a notice or counter-notification.
